WRONGFUL DEATH/TRUCKING ACCIDENT
Our law firm used all resources available to resolve the wrongful death case of John and Terri v. Roe Trucking. The Defendant trucking company’s initial settlement offer was $500,001; the offer was rejected by my firm. The Defendant truck driver made a dangerous left-hand turn from Highway 101 onto Wellsona Road in Paso Robles, California, causing the death of four people, including the son of my clients. Defendants blamed the accident on the drug impairment of the driver of the car in which our client’s son was a passenger. Our firm encouraged the District Attorney’s office to prosecute the truck driver, ultimately leading to a six-year prison sentence.
Defendant trucking company destroyed evidence to prevent our team from obtaining critical records. We conducted an intensive investigation into the corrupt and illegal business practices of the trucking company, resulting in a significant exposure to punitive damages should the case be tried. Our office relentlessly pursued punitive damages against the driver and the trucking company, arguing that Defendant’s trucking company facilitated the continued operation of a dangerous vehicle on a public highway. After a two and a half year battle, the case settled 25 days prior to trial, at a second mediation, for $4,500,000.
JOHN AND TERRI VS ROE TRUCKING
With only one camera at a distant gas station to record video evidence, this complicated trucking accident reconstruction was an engineering feat.
Our accident reconstructionists unlocked the mystery of this wrongful death, commercial trucking accident by incorporating gas station video, drones, landscape markers, truck and exemplar vehicle scans and specialized engineering software. (Watch the complete video below.)
Contrary to the police reports and statements provided by the truck driver and other witnesses, our experts proved the tractor trailer pulled directly in front of the car in which our clients’ son was traveling, killing him and all other occupants of the vehicle.
